伊方原発の再稼働、高裁が容認 差し止め仮処分取り消し via 朝日新聞
四国電力伊方原発3号機(愛媛県伊方町)の運転を差し止めた広島高裁の仮処分決定について、広島高裁は25日、四電の保全異議を認め、決定を取り消した。差し止めの法的拘束力がなくなったことを受け、四電は10月27日に3号機の運転を再開すると発表した。 異議審では、伊方原発から約130キロ離れた阿蘇山(熊本県)の噴火リスクが焦点となった。 三木昌之裁判長は決定で、火山に関する原子力規制委員会の安全審査の内規(火山ガイド)について、噴火の時期や程度を「相当程度の正確さ」で予測できることを前提としている点を「不合理」と述べた。 (略) 仮処分を申し立てたのは広島市と松山市の住民。広島地裁は昨年3月に住民側の申し立てを退けたが、広島高裁は同12月、これを不服とした住民側の即時抗告を認めて、運転を差し止める決定を出した。四電が保全異議を申し立て、異議審では広島高裁の別の裁判官3人が審理していた。住民側は最高裁への不服申し立てを見送る方針。 伊方原発3号機をめぐっては、大分地裁で今月28日、別の住民による運転差し止めの仮処分申し立てに対する決定が出る予定。(新谷千布美) 全文は伊方原発の再稼働、高裁が容認 差し止め仮処分取り消し
