東電元幹部の「注意義務」と「予見可能性」-原発を止めておけばよかった via Yahoo!News

かつて公害裁判では、「注意義務」は、最重要ポイントの一つだった。「知っていたのに対策を取らなかった」という被害側の主張に対して、被告は「いや、知らなかった」で済ませようとする。そこで重要なのは、「知っていたのに対策を取らなかった」ことを明らかにする証拠である。

東京電力福島第一原発事故の「業務上過失致死傷罪」で強制起訴された3人の東電元幹部刑事裁判でも、構造は似ている。

被告である勝俣恒久元会長、武黒一郎元副社長、武藤栄元副社長は、6月30日の初公判で「津波による事故を予見するのは不可能だった」などと無罪を主張した。つまり、予見できなかったのだから、注意しようがないという論だ。

公害裁判の教訓「注意義務」

たとえば、水俣病では、「1962年以前には知らなかった」で済ませようとする被告に対し、原告側は、水俣病被害は1955年以降に起きており、排出者には十分な注意義務があった旨を主張した。

その結果、裁判所は、化学工場が廃水を工場外に放流するにあたっては、常に最高の知識と技術を用いて廃水中に危険物混入の有無および動植物や人体に対する影響の如何につき調査研究を尽してその安全性を確認しなければならない。

また、万一有害であることが判明し、あるいは又その安全性に疑念を生じた場合には、直ちに操業を中止するなどして必要最大限の防止措置を講じ、とくに地域住民の生命・健康に対する危害を未然に防止すべき高度の注意義務を有するとして、被害者側が勝った。(拙著「四大公害病」中公新書より一部抜粋)

原発が抱える放射性物質は、万一有害どころか、事故以前から有害であることは周知の事実であり、常識的に考えれば、東電に課せられる「注意義務」は水俣病の原因企業であるチッソの比でないことは明らかだ。

東電の「注意義務」は法令でクリア

指定弁護士の冒頭陳述は、その注意義務が、原発では数々の法令に定められていることを明らかにした。

1.原子炉等規制法は、原子炉施設の保全、原子炉の運転について、「保安のために必要な措置を講じなければならない」(第35条第1項)と定めている。

2.電気事業法は、「事業用電気工作物を設置する者は、事業用電気工作物を経済産業省令で定める技術基準に適合するように維持しなければならない」39条第1項)と定めている。

3.発電用原子力設備に関する技術基準を定める省令(経済産業省令)は、「原子炉施設並びに一次冷却材又は二次冷却材により駆動される蒸気タービン及びその附属設備が想定される自然現象(地すべり、断層、なだれ、洪水、津波、高潮、基礎地盤の不同沈下等をいう。ただし、地震を除く。)により原子炉の安全性を損なうおそれがある場合は、防護措置、基礎地盤の改良その他の適切な措置を講じなければならない」(第4条第1項)と規定している。

つまり、水俣病の裁判では、「注意義務」の根拠を打ち立てることにも困難を極めたが、東電裁判では、それが易々と政府の定めた法令で「なければならない」とされたことによってクリアされている。

その一つは郡山市で市議をしている蛇石郁子さんの報告だ。

「(被告は)互いをかばい合う証拠を持ってきた。津波を想定していないというもの。こちら側の証拠は、とにかく会議をたくさんたくさん、東京電力の中でたくさーん会議を開いていて、その結果、対策を実際に取らなかったということがよく分かる内容になっていた。最後には、実際に巨大な地震が想定以上のものが来てしまったので、防潮堤を作っても役に立たなかっただろうと(被告側は)言った。じゃ、なんのための会議だったのか」

そして、海渡弁護士は冒頭陳述から次のように読み上げた。

「10m盤を超える津波の襲来から、本件原子力発電所を守る対策としては、

1.10m盤上に想定水位を超える防潮堤を設置するなど、津波が敷地へ遡上するのを未然に防止する対策、

2.建屋の開口部に防潮壁、水密扉、防潮板を設置するなど、防潮堤を越えて津波の遡上があったとしても、建屋内への浸入を防止する対策、

3.建屋の開口部に水密扉を設置する、配管等の貫通部に止水処理を行うなど建屋内に津波が浸入しても、重要機器が設置されている部屋への浸入を防ぐ対策、

4.原子炉への注水や冷却のための代替機器を津波による浸水のおそれがない高台に準備する対策、があり

これらの全ての措置をあらかじめ講じておけば、本件事故の結果は未然に回避することができました。東京電力は、本件事故後、事故調査報告書において、これらのことを明らかにしています。

そして、津波はいつ来るか分からないのですから、津波の襲来を予見したなら、これらの安全対策が完了するまでは、本件原子力発電所の運転を停止すべきだったのです。」

海渡弁護士はここが重要だとして、次のように強調した。

「どの時期に10m盤を超える津波が襲来することを予見できた予見できたか、しなければならないかが、大きな争点になると思われていたんですが、(検察役の指定弁護人たちは)原発を止めておけば良かったんだという論を立てています。」

報告会後の記者会見では、福島原発告訴団長の武藤類子さんも感想を求められ、「(東電が)お金と労力を惜しまなければ、こんなにたくさんの人が苦しむことはありませんでした」と振り返った。

Coastal Fukushima women late in checking breast cancer suspicions since 3/11: study via The Japan Times

Women along Fukushima’s northern coastline have been waiting longer to consult doctors about breast cancer suspicions since March 2011, according to a study by a local doctor.

The study was conducted by Akihiko Ozaki, a doctor at Minamisoma Municipal General Hospital in Minamisoma, Fukushima Prefecture, who noticed that many women began visiting him only after their symptoms had progressed.

Early diagnosis is the key to breast cancer treatment. If a woman waits three months or longer to see a doctor after noticing symptoms, her prognosis is likely to be poor.

A doctor with knowledge of medical conditions in disaster-affected areas said the same trend could emerge in other areas hit by disasters, including the Tokyo metropolitan area, where the population is graying just like the rest of Japan.

Breast cancer is the most common cancer among women in Japan and around 13,000 die from it every year. The number of patients has been rising, highlighted by the death of popular TV personality Mao Kobayashi last month at the age of 34.

Ozaki’s study, published in a British cancer journal, covered 219 patients who, after noticing lumps or other symptoms, visited either of two hospitals in Minamisoma between 2005 and 2015. Of the total, 122 had visited before March 11, 2011, and 97 afterward.

ベトナム原発計画中止で無視される「民意」 史上最悪の海洋汚染事件と重なる「構図」 via 東洋経済online

「原発は安全だと聞いていたから、なにも心配はしていませんでした。(移転予定の)新しい土地は水が出るし。先祖の墓を移す必要がなくなったのはよかったけどね」

日本で起きた震災と事故から、村には原発を不安視する声もあった。ただし、グォーさん聞くとそれはごく一部で、期待していた賠償金を手にできずに「残念がる人が多い」と笑う。この村では原発の“安全神話”は健在なのである。

原発計画自体についても、村民には中止ではなく、一時的な停止と伝えられたそうだ。理由は資金難とだけされ、将来の建設再開に含みを残した説明だった。

「国家の発展のためには原発は必要だと思います。前のグエン・タン・ズン首相のままなら原発はできていた。前と今の指導者で、考え方の違いがあるのでしょう」

グォーさんはなにも水を向けていないのに、「国家」と「指導者」いう予期せぬ言葉を持ち出して話を終わらせる。原発計画は始まりも終わりも、結局は民意の及ばない別の場所で決定が下されていた。

「環境」は新しいビジネス

原発中止の理由で、一部でささやかれた外資企業フォルモサ社が昨年起こした「ベトナム史上最悪の公害」との関連についても小高さんは言及する。

「対外的に相当なリスクがあっても原発を中止にした。少なくともフォルモサとか、環境問題とはあまり関係ないでしょうね」

ただ、近年ベトナムでは、開発計画の中に「環境に配慮した」という言葉をよく目にする。火力発電なら「環境に配慮した石炭」、水産養殖なら「環境に配慮したエビ池」などなど。現地で長年活動を続ける環境NGOの関係者に聞くと、

「最近は環境問題絡みは国際機関から予算が出やすい。国と役人たちにとって、『環境』は儲かる新しいビジネス」

と返ってきた。

昨年の「ベトナム史上最悪の公害」にも、政府とフォルモサ社の間ですでに5億ドルの賠償金を含んだ示談が成立している。この金額は一企業に課す罰金としてはベトナムでは最高額らしい。ベトナム政府は2014年に新環境保護法を制定するなど、「環境」を考慮した法令整備と罰則強化を進めている。被害規模もさることながら、「環境」絡みの企業責任にはいまや高値がつく。そして、原発中止の理由にも「環境に配慮した」は使われていた。

そもそも市民の一連の抗議活動に火をつけたのは、発覚してすぐのフォルモサ社側責任者による

「魚やエビか、それとも製鉄所か。ベトナムはどちらかを選ばなければならない」

との発言だった。当然市民は「魚を選ぶ」と反発。製鉄所=経済発展ではなく、魚=自然環境を守るべきとネットを中心に反フォルモサ運動は拡大した。

ドンイェン村では15歳以上の住民すべてが、フォルモサ社の賠償責任を問う訴訟に参加している。そこでは国とフォルモサ社の“手打ち”にはない「工場の操業停止」と「海を美しい状態に戻せ」との項目が入っている。

しかし、現状では国はこれらに耳を傾けることなく、ドンイェン村の漁民の一部にはいまだ賠償金が支払われない者も多い。それどころか住民は強制立ち退きが迫られ、広がる廃墟のような風景。その隣ではすでにフォルモサ社の製鉄所は試運転を開始し、6月に操業が始まったと伝えられる。

柳美里さん 南相馬で書店開業目指す 福島に移住 via 毎日新聞

芥川賞作家の柳美里(ゆう・みり)さん(49)が2日、東京電力福島第1原発から20キロ圏内の福島県南相馬市小高(おだか)区に移住した。家の一部を改装して書店開業を目指す。

柳さんは震災翌年に同市の臨時災害放送局からラジオ番組の進行役を頼まれ、神奈川県鎌倉市から通い詰めた。知人が増え、2015年4月に家族と共に原発30キロ圏内の同市原町区へ移住。番組にはこれまで500人以上が出演し、柳さんは震災の話に耳を傾けた。

 小高区に今春誕生した小高産業技術高校の校歌の作詞を頼まれた柳さんは、生徒が立ち寄れるカフェ併設の書店を小高区に開こうと昨年から模索していた。すると今年2月に突然、原町区で育った早稲田大2年の男子学生(19)が自宅を訪れ、小高駅前の土地と家を買ってほしいと頼まれた。学生によると、そこは母方の実家だが震災の混乱で祖母たちが手放さざるを得なくなってショックを受け「せめて信頼できる人に」との思いだった。

 資金は苦しい。「銀行に融資を申し込んだら『小高で書店なんてボランティアだ』と断られた」と柳さん。今後、ネット上の募金「クラウドファンディング」を活用する。

もんじゅ 廃炉、課題山積 どうする液体ナトリウム /福井 via 毎日新聞

昨年末に廃炉が決まった高速増殖原型炉もんじゅ(敦賀市)について、日本原子力研究開発機構は6月13日、工程を定める廃止措置計画の前段となる基本計画を国に提出した。作業は今後本格化するが、水と激しく反応する液体ナトリウムを大量に使う高速炉の廃炉は国内に例がなく、技術的ハードルは高い。政府が基本方針で明記した使用済み燃料の県外搬出も見通しが立っておらず、政治的に不透明な部分も多い。【近藤諭】

 冷却材に使う液体ナトリウムは、もんじゅ内に1670トンもあるが、抜き取りや抜き取り後の処理の具体的な方法はまだ決まっていない。

 760トンある2次系冷却材は、放射性物質を含まないため、別施設での再利用や工業用として売却することが考えられる。

 一方、原子炉内を循環する1次系760トンと、原子炉から取り出した燃料を一時保存する炉外燃料貯蔵槽にある150トンは、放射性物質を含むため、化学処理した上で廃棄する必要がある。

 また、取り出したナトリウムを保管するタンクの容量も、1次系540トン、2次系725トンで、いずれも一度に抜き取ることはできない。原子力機構は、仮設タンクの設置なども検討している。

搬出先、見通し立たず

 順調に燃料を取り出せても、搬出先については「県外へ」との方針が示されているだけだ。茨城県東海村の再処理施設は14年に廃止が決定しており、フランスなど海外での再処理が考えられる。

 ただし、同じウラン・プルトニウム混合酸化物(MOX)燃料を使った廃炉中の新型転換炉ふげん(敦賀市)では、03年の運転停止時にあった使用済み燃料738体のうち466体の搬出先が決まらずに残されたまま。もんじゅも約束通り県外に搬出される保証はない。

Ex-SF Navy shipyard workers allege fraud in radiation cleanup via SF Gate

The cleanup of radioactive contamination at the Hunters Point Shipyard was marred by widespread fraud, faked soil samples, and a high-pressure culture where speed was valued over accuracy and safety, according to four former site workers.

On Thursday, the four whistle-blowers, including a radiation safety officer who reported directly to the Nuclear Regulatory Commission, gathered with environmentalists to describe the problems with the cleanup, which has cost the federal government $600 million. In the background, construction crews were at work redeveloping the property, where 1,200 units of housing, millions of square feet of commercial space and hundreds of acres of parks are planned.

David Anton, an attorney for the workers, said the Navy and the Environmental Protection Agency — as well as the district attorney and state attorney general — should immediately launch investigations into the cleanup, a process that should include interviews with former workers and the retesting of the soil at the site. Also, the nonprofit Greenaction for Health and Environmental Justice filed a petition with the NRC to revoke the license of contractor Tetra Tech, which oversaw the cleanup at the Superfund site.

Questions over the accuracy of the soil tests emerged in October 2012, when the Navy discovered that some results were inconsistent with results from previous samples collected in the same areas. While the dirt in question was identified as having been collected from beneath a lab used to conduct radiation tests on animals, an internal investigation found that in at least 386 cases it had been pulled from areas already given a clean bill for radiological contamination.

On Thursday, the former workers said soil samples from areas known to be highly contaminated were switched with dirt gathered from the foundation of an old movie theater, where there were minimal toxic chemicals. Anton alleges that at least 2,500 samples were faked. 

Robert McClain, a radiation technician who worked at the site in 2005, said Tetra Tech management ordered him to increase the speed of a conveyor-belt system he operated — even though the soil carried by the belt could not be properly tested for contaminants at the faster speed.

EDITORIAL: Fukushima trial should clarify why TEPCO execs didn’t act via The Asahi Shimbun

The first criminal trial over the 2011 Fukushima nuclear disaster is now under way, drawing fresh attention to key questions concerning the devastating accident and its lasting reverberations.

The focus of public attention will be on whether the reams of evidence collected by public prosecutors, along with statements by those in charge, will provide a clearer picture of how the disaster unfolded.

Three former executives of Tokyo Electric Power Co., which operated the crippled Fukushima No. 1 nuclear power plant, pleaded innocent June 30 in the first hearing held at the Tokyo District Court.

They are charged with professional negligence resulting in the deaths of 44 people who had to be evacuated from a hospital near the plant, and injuries of others.

While the Tokyo District Public Prosecutors Office twice decided not to press charges against the three, citing a lack of evidence, independent judicial panels of citizens voted for mandatory indictments against them.

In his opening statement, the lawyer acting as a prosecutor asserted that the three former TEPCO executives had the “ultimate obligation and responsibility” to ensure the safety of the nuclear facility.

He cited a 2008 estimate by a TEPCO subsidiary involved in the operation of the Fukushima plant that pointed to the “shocking” possibility of the plant being struck by tsunami of up to 15.7 meters. The TEPCO officials proposed that measures be taken to protect the plant from such a tsunami, including the construction of a seawall, but the three executives decided to postpone taking such steps.

The defense team countered by reiterating its argument that it was merely one of many estimates and constitutes no reason to claim that the defendants were able to predict and avoid the accident.

In 2002, a government agency warned that a massive earthquake capable of generating huge tsunami could occur anywhere off the Pacific coast from the northern Sanriku region in Tohoku down to the Boso region in Chiba Prefecture.

The huge 2004 Indian Ocean earthquake and tsunami caused damage to nuclear power facilities in India.

Japanese nuclear regulators at that time called for steps to enhance the safety of nuclear power plants.

Criminal trials are held to determine whether the defendants should be held criminally liable.

The rights of the defendants provided by the Constitution and the Criminal Procedure Law should, naturally, be respected. That means there is a limit to what a criminal court can do to clear up the truth.

While recognizing the limitations of what a criminal trial can achieve, we sincerely hope it will shed new light on the accident.

This hope is obviously shared by not just the survivors who have lost their families and hometowns in the accident but also countless others who were affected by the disaster.

The defendants have a duty to help disclose the truth.

In addition to determining whether or not the defendants are guilty of professional negligence, the trial offers an opportunity to reflect deeply on some key questions concerning nuclear power and the related roles of electric utilities and the government; for example, can the safety of nuclear plants be ensured and is there really a viable future for nuclear power generation in this earthquake-prone nation.

福島第1原発事故 東電旧経営陣初公判 真実こそが誠意 被災者、厳しい目 via 毎日新聞

多くの人から古里と生きる糧を奪った原発事故。避難生活を余儀なくされる被災者は、法廷に立った東電旧経営陣に何を思うか。

 「事故の影響は今も全く収束していない。旧経営陣はその責任を感じて証言台に立ち、誠意をもって真実を話してほしい」。事故直後に福島県南相馬市から群馬県内に避難した男性(79)は強い口調で訴える。

 男性は福島から群馬県などに避難した住民ら137人が東電と国に損害賠償を求めた集団訴訟の原告の一人。南相馬市で居酒屋を経営していたが、事故で常連と店を失った。店の後継を託すつもりだった孫や次女とも別居を余儀なくされ、生きがいも奪われた。

 今年3月、前橋地裁で各地の同種訴訟で最初の判決が出た。東電と国の責任を認める画期的内容だったが、東電も国も控訴した。「『やっぱりか』とあきれた。東電には加害者という自覚が全く感じられない」と憤る。

 一方、福島第1原発が立地し、避難指示の解除が見通せない福島県大熊町から隣の田村市に避難した石田宗昭さん(78)は「旧経営陣が罰せられても、暮らしが良くなるわけではない。被害は償い切れない」と冷ややかだ。

 事故前は、3ヘクタールの田畑でコメと大豆、裏山では約3500本の原木でシイタケを栽培していた。自家製の「しいたけ味噌(みそ)」は町の特産品にもなり、全国から注文が入った。だが、事故が起きると、同居していた長男夫婦と孫3人とは分かれて避難し、今は妻と2人で中古住宅で暮らす。農業への未練を引きずりながら、小さな庭でキュウリやタマネギなどを育てる日々だ。

 東電への思いは複雑だ。原発のおかげで町は豊かになり、地域の特産品の即売会を東京で開いてくれた恩も感じる。「裁判は、東電が『復興に一層力を入れよう』と思う機会になればいい」と話す。【杉直樹、土江洋範】

この日の公判では、起訴状朗読と3被告の認否に続き、検察官役の指定弁護士が1時間半超、弁護人が1時間弱にわたって冒頭陳述を行った。その後、指定弁護士と弁護人の双方が証拠の内容を計約2時間読み上げ、休憩時間を除くと約5時間にわたる審理となった。

 原発事故を巡る東電の刑事責任追及を求めてきた「福島原発刑事訴訟支援団」のメンバーなど被災者らも初公判を傍聴、閉廷後に永田町の参議院議員会館で報告会を開いた。福島県いわき市議の佐藤和良団長(63)は「ようやく(刑事裁判が)始まった。東電の経営陣にはしっかり罪を償ってほしい」とあいさつした。いわき市出身の社会学者、開沼博さんも裁判を傍聴。「裁判で事実の解明が進むことを望みたい」と話した。【飯田憲、平塚雄太、巽賢司】

東電のメモやメール、明らかに

 30日午後の法廷で、検察官役の指定弁護士は主張を裏付ける証拠として、東電内部の打ち合わせメモや担当職員らによるメールのやりとりなどを次々に明らかにした。

 東電の津波対策の担当者が2008年に送ったとされるメールには「マグニチュード(地震の規模)8の地震を設定すると、(想定される津波の高さは)従前を上回ることは明らか」などと記載され、「(原発を)停止させないロジック(論理)が必要」とも書かれていたと説明した。

 また、東電の技術者も参加する土木学会の同年の議事録には「十数メートルになる津波が来て浸水すれば致命的」などと記載してあったと指摘。「津波対策を開始する必要あり」などと記されたメモもあるとした。

 一方、弁護側も10メートル超の津波が来る可能性があるとする試算について、「誤差を含んでいる点を十分留意すべきだ」などと注意を促した当時の内閣府の指摘などを証拠として提出した。【近松仁太郎】

Ex-Tepco Leaders Plead Not Guilty in Fukushima Nuclear Trial via Bloomberg

A prosecutor told the court that the three defendants had access to data and studies that anticipated the risk of a tsunami exceeding 10 meters (30 feet) that could trigger a loss of power and severe accidents.

“They continued running the reactors without taking any measures whatsoever,” the prosecutor said. “If they had fulfilled their safety responsibilities, the accident would never have occurred.”

The lawyers in a Japanese trial are generally not identified by name.

The prosecution began presenting more than 230 pieces of evidence including emails between safety officials and the two vice presidents that suggested increasing concern and a need to take additional tsunami measures at the Fukushima plant.

TEPCO was already conducting a tsunami safety review following a 2007 earthquake in northern Japan, and the three former executives routinely participated in it, according to the prosecutors. In March 2008, a TEPCO subsidiary projected that a tsunami as high as 15.7 meters (47 feet) could hit Fukushima based on historical data, prompting a consideration of the construction of seawalls, the prosecution said.

In an email that year, a TEPCO construction official said the updated tsunami estimate made Fukushima’s safety measures insufficient, and they needed a “logical” excuse to keep the plant running. At a meeting later that year among TEPCO construction officials, a tsunami exceeding 10 meters (30 feet) was described as “disastrous.” Muto later instructed them to take time for a further examination by experts, in effect delaying the plan, the prosecution said.

The three men are charged with professional negligence resulting in death and injury, including the deaths of more than 40 senior citizens during and after evacuation from a hospital, and injuries to 13 people including TEPCO employees during emergency work.

Government and parliamentary investigative reports have said that TEPCO’s lack of a safety culture and weak risk management, including an underestimation of tsunami risks, led to the disaster. They also said TEPCO ignored tsunami protection measures amid collusion with regulators and lax oversight.

TEPCO has said it could have been more proactive with safety measures, but that a tsunami of the magnitude that crippled the plant could not have been anticipated.

The criminal trial for the TEPCO executives was prompted by an appeal by more than 5,700 people from Fukushima and other parts of Japan, urging prosecutors to investigate and send the utility executives to court to determine who was responsible for the disaster.
